Applying for an FSP licence involves applying to the registrar of the Financial Sector Conduct Authority. In order to become authorised, the entity would need to meet certain licensing requirements and must comply with a code of conduct before obtaining their licenses.
The entity would also need to adhere to Fit and Proper status, which would include financial soundness, as set out by the Financial Advisory and Intermediate Services Act, before they can give advice on the various categories of financial products and obligations.
Representatives (Advisors)
A Representative is any person, including someone employed or mandated by a Financial Services Provider (FSP), who provides financial services to clients on behalf of the FSP. This role is performed under the terms of employment or another type of mandate.
However, it excludes individuals performing clerical, technical, administrative, legal, accounting, or other services in a subsidiary or subordinate capacity. These services do not require judgment on the part of the individual, nor do they lead a client to any specific financial product transaction in response to general inquiries.
Representatives are appointed by FSPs, which must ensure that these representatives are fit and proper. Once approved, representatives are registered with the Financial Sector Conduct Authority (FSCA).
